Terms of Service
These Terms of Service (the "Terms") govern your use of Eviction Defender, including the website at www.evictiondefender.app and the app at app.evictiondefender.app (together, the "Service"), provided by Landlord 360 Network LLC ("we," "us" or "our"). By creating an account or using the Service, you agree to these Terms.
1. What the Service is
Eviction Defender is self-help software for tenants. It gives general information about eviction procedures in your state, helps you track deadlines, and fills in court forms and letters using the answers you give. You decide what to sign, file, send or say. The Service does not file documents with any court for you, does not appear in court for you, and does not talk to your landlord or the court for you.
2. Not a law firm; no legal advice
Landlord 360 Network LLC is not a law firm and does not provide legal advice. No attorney-client relationship is created by your use of the Service, by speaking with our staff, or by any document the Service prepares. Our staff are not lawyers and cannot tell you which defenses to use or what to do in your case. Information, plans, dates and documents produced by the Service may be incomplete, out of date or incorrect, and laws and court procedures vary by location and change over time. Dates printed on your court papers always control over any date the Service shows. You are responsible for reviewing all content and confirming requirements with the court clerk, a legal aid office, or a licensed attorney. The Service lists free legal aid organizations in your state, and we encourage you to contact them.
3. Your account
You must give accurate information and keep access to your phone and email secure, since sign-in codes are sent there. You are responsible for activity under your account. You must be at least 18 years old.
4. Acceptable use
- You will use the Service only for your own housing matter, for lawful purposes, and you will give true information in any document you sign.
- You will not use the Service to make false statements to a court or to anyone else.
- You will not attempt to interfere with, reverse engineer or gain unauthorized access to the Service.
5. Electronic signatures
When you sign a document electronically in the Service, you agree that your electronic signature has the same effect as your handwritten signature. Some courts require a handwritten or notarized signature, and the Service will remind you to check this with your court.
6. Fees
Some parts of the Service are free, including your step-by-step plan, deadline reminders, state information and the list of free legal aid. Other parts require paid access, at the price shown before you pay. A one-time fee gives access for the number of days shown. A monthly plan renews each month until you cancel, and you can cancel at any time in the app; access continues until the end of the period you paid for. Court filing fees, mailing costs and other third-party costs are your responsibility, though the Service can help you ask the court to waive its fees.
7. Your content
You keep ownership of the information and documents you enter or create. You give us a limited license to host, process and send that content only to provide and support the Service. Our handling of personal information is described in our Privacy Policy.
8. No guarantee of outcome
We do not guarantee any result in any eviction or court case, including that a court will accept a document, grant a request, or give you more time.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
11. Ending your use
You may stop using the Service at any time. We may suspend or end access if you violate these Terms or use the Service in a way that could harm others or the Service. Sections that by their nature should survive will survive.
12. Changes
We may change the Service and these Terms from time to time. We will post updated Terms here and change the effective date above. Continued use after changes take effect means you accept the updated Terms.
